A Federal High Court in Abuja, yesterday, declined to include the Caretaker Chairman of the All Progressives Congress (APC), Governor Mai Mala Buni of Yobe State, as a defendant in a suit challenging the emergence of Andy Uba as the party’s candidate in the November 6 governorship election in Anambra State.
Justice Ahmed Mohammed held that since the applicant could not prove that the party to be joined influenced the primary election, the joining would be unnecessary.
The court further held that it was only necessary to join parties in suit when there was a complaint against them. Dismissing the application seeking to join APC national chairman in the suit, Mohammed fixed September 21 for hearing of substantive suit.
Prof. George Moghalu had claimed, in the suit, that APC did not comply with the relevant provisions of the Electoral Act 2010 and the party’s regulations and guidelines in the conduct of its governorship primary in Anambra.
