The wife of Late Chief Ikponmwosa Aguebor under the Marriage Act, Mrs. Veronica Aguebor and the issues of the said marriage have approached a Benin City High Court vide Suit No: B/794/2023 seeking several Reliefs against Hopkins Osamuyi Aguebor and Osamudiame Aguebor sued as Defendants in the suit.
Mrs. Veronica Aguebor and the other Claimants are seeking a Declaration that Hopkins and Osamudiame Aguebor are not entitled to any share in the residuary estate and personal chattels of Late Chief Ikponmwosa Aguebor as their paternity was not at any material time acknowledged by Late Chief Ikponmwosa Aguebor who refused to perform any putative duties of a father to the Defendants in his life time.
In the ALTERNATIVE, the Claimants are seeking an Order of Court to subject the Defendants to DNA test. The Claimants further seek a Declaration that the residuary estate of Late Chief Ikponmwosa Aguebor can only be distributed in accordance with the Administration of Estate Law applicable to Edo State since Late Chief Ikponmwosa Aguebor was married to Mrs. Veronica Aguebor under the Marriage Act.
The suit was instituted on behalf of the Claimants by the Law firm of WEST-IDAHOSA, SAN & CO.
No date has been fixed for hearing.
